Standard Editorial Terms of Service

Payment

  • Half of the fee is to be paid in advance, before the Editor begins work. The remainder of the fee is to be paid when the Editor notifies the Client that the work is finished.
  • Book-length manuscripts may be paid for on a chapter-by-chapter basis, with each chapter payable in advance.
  • The Editor accepts payments via PayPal. Other forms of payment (check, money order, cash) are accepted on a case-by-case basis.
  • Payments are due 3 days after invoice. Late payments will be assessed a 5% late fee for the first 5 days after delinquency, 10% for 10 days, and 20% for 15 days.
  • Payments not remitted after 15 days will be turned over for collections.

Rights

  • The Client retains all rights to the manuscript(s).
  • The Editor will retain an electronic copy of each version of each manuscript for 10 days after the last revision is delivered to the client. This allows the Editor to refresh his memory of the revisions done in case the Client asks for a review.
  • Copies of the manuscript(s) retained by the Editor are for the Editor’s use only and will not be made available to any individual or entity.

Follow-up Readings and Reviews

  • At the request of the client, the Editor will provide one (1) complimentary follow-up reading with the Client. This reading will ensure that the Client has:
    • understood the Editor’s markup,
    • chosen to address the markup appropriately, and
    • not introduced any errors or misunderstandings based upon the Editor’s work.
  • Follow-up readings are limited to one thirty-minute telephone, AIM, iChat, or email conversation, per manuscript.
  • The Client must request a follow-up reading before major changes (outside of those suggested by the Editor) are made to the manuscript. Any attention to the manuscript from the Editor after major changes in content or structure is considered a review and will be billed as such.
  • Reviews are essentially a repeat of the editing process, but with the updated manuscript. Reviews may be requested by the Client and are usually billed at 1/3 the original rate.

Indemnity

  • While the Editor will make every effort to bring questionable material to the attention of the Client, the Client agrees to indemnify and save harmless the Editor from any and all claims or demands, including legal fees, arising out of any alleged libel or copyright infringement committed by the Client in creating the work. Similarly, the Editor agrees to indemnify and save harmless the Client from any and all claims or demands, including legal fees, arising out of any alleged libel or copyright infringement committed by the Editor in creating the work.
  • The Editor does not represent nor is he affiliated with any agent or publisher of literary works. The Editor makes no representations or warranties that he can or will attempt to have the manuscript published or aid in publishing the manuscript.
  • The Editor will use his background and experience in editing the manuscript, recognizing that this experience, while successful for him, may not be successful for the author. The Editor's sole function is to aid and assist the Client in editing the manuscript. In this light the Editor will make his best efforts to advise and suggest changes to improve the manuscript. The decision to accept or reject the editor's suggestions is solely the Client’s.
  • There are no guarantees in the field of publishing. The acceptance of a manuscript for publication is the subjective decision of a publisher and its editors. This Editor, while working to aid the Client in preparing the best manuscript possible given the submitted material, has no way of judging the market or publishing industry.
